EPISODE 5: Will ICE Be at the Polls? They Won’t Say No.

Could ICE agents show up at your polling place this November? And if they did, would it even be legal?

Episode 5 of the Clear Reception podcast follows a promise that kept shrinking. In February, a Homeland Security official told election officials there would be no ICE at polling places. By September, the head of Homeland Security was saying agents could come to serve a warrant. I line up what the administration has said, explain why the fear can keep people home even if no agent ever shows up, cover the 1865 law that bans armed federal agents at the polls, and walk through what you can do.

If you see federal agents at a polling place: don’t approach them. Tell a poll worker, then call or text Election Protection, a nonpartisan hotline with volunteer lawyers: 866-OUR-VOTE (866-687-8683), or 888-VE-Y-VOTA (888-839-8682) for Spanish/English. Corrections & clarifications: On air I said “Denver and several other civil rights groups.” Denver joined the lawsuit as a city and county, alongside LULAC, Common Cause and UnidosUS. As of Oct. 18, there’s still no ruling; the judge has asked the parties to discuss combining it with two related lawsuits. ProPublica’s count of 170+ U.S. citizens held by immigration agents covers cases through early October 2025.

Closing quote: “The most potent weapon in the hands of the oppressor is the mind of the oppressed.” Steve Biko, anti-apartheid activist, 1971. More about Biko - South African History Online
